China Is First-to-File

In China, trademark rights generally belong to whoever files first, not whoever used the brand first. Squatters routinely register foreign brand names, then block customs, marketplaces and distributors — or demand a large payment to transfer the mark back.

Registering early is inexpensive insurance. A Chinese trademark is also commonly required by Tmall, JD, Amazon China, customs recordal and local distributors.

Your home-country registration gives you no protection in China. You need a separate Chinese trademark (or an international Madrid Protocol designation covering China).

Yes. Foreign companies and individuals can register trademarks in China, normally through a licensed Chinese trademark agent. You can also extend a home registration via the Madrid Protocol designating China.
If no opposition is filed, registration typically takes around 9 to 12 months, including a publication period. A search beforehand reduces the risk of refusal.
